Uber arbitration unquestionably unenforceable

The big question on appeal in the ongoing Uber litigation is whether the trial judge was right to find Uber's mandatory arbitration agreement unenforceable.

Early this month, Uber received permission to appeal U.S. District Judge Edward Chen's class certification ruling in the closely watched case involving the employment status of its drivers. The big question on appeal is whether Chen was right to find Uber's mandatory arbitration agreement unenforceable. He was.
