Mental Incompetence Requires Same Burden of Proof as Insanity
Affirming a judgment that sent a mentally retarded man to prison for 25-years-to-life, the Court of Appeal in Ventura has ruled a defendant claiming mental incompetence must meet the same burden of proof as one using an insanity defense.
