Igniting discourse: a legal perspective on July Fourth fireworks
Can an individual escape liability simply by relying on the fact that the fireworks that caused the harm were “safe and sane?” If so, then an automobile driver whose reckless driving causes death or injury should be able to argue that his valid license and properly registered vehicle immunize him from liability. We know this is illogical.
