Judge denies Grubhub’s motion to toss PAGA claim

“Grubhub has not established that the plaintiff lacks statutory standing to pursue PAGA penalties for delivery drivers who suffered Labor Code violations during times other than the four months the plaintiff drove for Grubhub,” U.S. District Judge Jacqueline Scott Corley wrote.

A federal judge denied Grubhub’s motion for partial summary judgment in a legal battle over the scope of a plaintiffs’ class that seeks penalties under the Private Attorneys General Act.

Attorneys for Grubhub argued last month to limit the scope to drivers employed during the lead plaintiff’s four-month employment from 2015-2016 and dismiss the PAGA claim entirely.
