ENERGY AND UTILITIES

• AB 3, Zbur. Offshore wind energy: reports. Establishes the California Offshore Wind Advancement Act to develop a strategy for seaport readiness for offshore wind energy developments, and to study the feasibility of achieving 70% and 85% in-state assembly and manufacturing of offshore wind energy projects, as provided. An act to amend, renumber, and add Section 25991.8 of, and to add Section 25991.9 to, the Public Resources Code, relating to energy.

• AB 50, Wood. Public utilities: timely service: customer energization. Requires the California Public Utilities Commission (CPUC), to determine the criteria for customers to receive timely electricity service when requesting new service connections or upgraded service, known as "energization." Proposes several policies to address delays in connecting customers to the electrical grid, including improved information sharing with local governments, reporting by electric investor-owned utilities (IOUs), and other measures. An act to add Section 933.5 to the Public Utilities Code, relating to public utilities.

• AB 286, Wood. Broadband infrastructure: mapping. This bill expands the fields of data included on the California Interactive Broadband Map maintained by the California Public Utilities Commission's (CPUC). Specifically, this bill would allow users to submit specified self-reported data and requires the CPUC to validate self- reported data before using that data as evidence in a proceeding. An act to amend Section 281.6 of the Public Utilities Code, relating to communications.

• AB 604, Lee. Mobilehome parks: water utility charges. Applies existing rules regarding mobilehome park management's separate billing of water service provided via submeter to mobilehome parks whose water service is subject to the jurisdiction, control, or regulation of the California Public Utilities Commission (CPUC). An act to amend Section 798.40 of the Civil Code, and to amend Section 2705.5 of the Public Utilities Code, relating to mobilehomes.

• AB 631, Hart. Oil and gas: enforcement: penalties. Increases civil and other penalties for violations of the state's governing oil and gas statutes and regulations, and strengthens the Geologic Energy Management Division's (CalGEM) authority to seek injunctive relief, cease and desist specified activities, and recoup administrative and enforcement costs. An act to amend Section 338.1 of the Code of Civil Procedure, and to amend Sections 3224, 3236, and 3236.5 of, and to add Sections 3224.5, 3236.2, 3236.3, and 3236.6 to, the Public Resources Code, relating to oil and gas.

• AB 678, Alvarez. Biomethane procurement targets or goals: core transport agents. Expands the authority of the California Public Utilities Commission (CPUC) to establish biomethane procurement targets on gas corporations to also include core transport agents (CTAs-third-party natural gas providers), and requires the CPUC to initially allocate each CTA their proportionate share of the existing biomethane procurement targets established by CPUC Decision 22-02-025. The bill stipulates that, if the CPUC adopts the biomethane procurement targets or goals, the CPUC must authorize a CTA to be able to have a gas corporation procure the CTA's proportionate share of biomethane, with all costs paid for by the CTA and any environmental attributes allocated in a fair and transparent manner. An act to amend Section 651 of the Public Utilities Code, relating to energy.

• AB 1061, Rendon. Electricity Supply Strategic Reliability Reserve Program. Expressly requires facilities constructed by the Department of Water Resources (DWR) or under a contract with DWR for purposes of the Electric Supply Strategic Reliability Reserve Program (ESSRRP) to comply with California Air Resources Board (CARB) regulations regarding mandatory reporting of greenhouse gas (GHGs) emissions and compliance with the cap-and- trade program. An act to amend Section 80710 of the Water Code, relating to electricity.

• AB 1068, Valencia. Public Utilities Commission: ex parte communications. Deletes current prohibitions on written ex parte communication (communications about an issue before the California Public Utilities Commission (CPUC) that is provided outside the formal proceeding process) in specified proceedings at the CPUC. An act to amend Sections 1701.3 and 1701.9 of the Public Utilities Code, relating to the Public Utilities Commission.

• AB 1132, Friedman. Solar energy systems: permit fees. This bill extends the cap on what a city or county may charge for a permit to install a residential and commercial solar energy system from January 1, 2025, to January 1, 2034. An act to amend Section 66015 of the Government Code, relating to solar energy systems.

• AB 1167, Wendy Carrillo. Oil and gas: acquisition: bonding requirements. Requires a person who acquires the right to operate a well or production facility to file with the State Oil and Gas Supervisor (supervisor) a bond for the well or production facility in an amount determined by the supervisor to be sufficient to cover, in full, all costs of plugging and • ABandonment and site restoration. An act to amend Sections 3202, 3204, and 3205.5 of, and to add Sections 3017 and 3205.8 to, the Public Resources Code, relating to oil and gas.

• AB 1172, Calderon. Integrated energy policy report: fusion energy. Requires the California Energy Commission (CEC) to evaluate various fusion technologies and to analyze the feasibility of using nuclear fusion in the state as part of its 2027 integrated energy policy report (IEPR). An act to add and repeal Section 25302.4 of the Public Resources Code, relating to energy.

• AB 1373, Garcia. Energy. Provides the Department of Water Resources (DWR) authority to act as a centralized procurement entity (CPE) until January 1, 2035. Requires the California Public Utilities Commission (CPUC) and the California Energy Commission (CEC), as applicable, to assess capacity payments for load-serving entities (LSEs) and local publicly owned electric utilities (POUs) that are deficient in their reliability obligations until June 30, 2027. Finally, authorizes the CPUC additional enforcement and subsequent penalty authority over the LSEs' integrated resource plans (IRP). An act to amend Section 10295.6 of the Public Contract Code, to amend Sections 25795 and 25992.10 of, and to add Section 25302.6 to, the Public Resources Code, to amend Sections 365.1, 380, 454.51, 454.52, and 9620 of, and to add Sections 913.21 and 1001.1 to, the Public Utilities Code, and to amend Section 80720 of, to add Sections 80713 and 80714 to, and to add Division 29.5 (commencing with Section 80800) to, the Water Code, relating to energy, making an appropriation therefor, and declaring the urgency thereof, to take effect immediately.

• SB 38, Laird. Battery energy storage facilities: emergency response and emergency action plans. This bill requires each battery energy storage facility located in the state, and subject to specified safety requirements, to have an emergency response plan and emergency action plan that covers the premises of the battery energy storage facility. An act to amend Section 761.3 of the Public Utilities Code, relating to energy.

• SB 48, Becker. Building Energy Savings Act. This bill requires the California Energy Commission (CEC) along with other agencies, to develop to a state strategy to achieve state goals for energy and greenhouse gas (GHG) emissions from existing buildings. An act to amend Section 25402.10 of, and to add Section 25402.16 to, the Public Resources Code, relating to energy.

• SB 49, Becker. Renewable energy: Department of Transportation: evaluation. This bill requires, by December 31, 2025, the Department of Transportation (Caltrans), in coordination with the California Energy Commission (CEC) and the California Public Utilities Commission (CPUC), to evaluate the issues and policies impeding development of land within the Caltrans right of way for renewable energy, energy storage, and electric transmission and distribution facilities. An act to add Section 91.9 to the Streets and Highways Code, relating to energy.

• SB 123, Committee on Budget and Fiscal Review. Energy. The bill is the omnibus Energy budget trailer bill. It contains provisions necessary to implement the 2023 Budget Act. An act to amend Section 11553.5 of the Government Code, to amend Sections 38561.3, 44268, and 44268.2 of, and to add Section 44268.4 to, the Health and Safety Code, to amend Section 379.10 of the Public Utilities Code, and to amend Sections 80400 and 80710 of the Water Code, relating to energy, and making an appropriation therefor, to take effect immediately, bill related to the budget.

• SB 124, Committee on Budget and Fiscal Review. Energy. The bill is the omnibus energy budget trailer bill. This bill contains provisions necessary to implement the 2023 Budget Act. An act to amend Sections 63048.93 and 63048.95 of the Government Code, to amend Sections 25355.5, 25371.3, 25373, and 25792 of the Public Resources Code, to amend Sections 454.53, 712, 712.1, and 712.8 of, and to add Section 913.20 to, the Public Utilities Code, and to amend Sections 80400, 80710, and 80720 of, and to add Sections 12935.5 and 80700.5 to, the Water Code, relating to energy, and making an appropriation therefor, to take effect immediately, bill related to the budget.

• SB 286, McGuire. Offshore wind energy projects. This bill establishes the California Offshore Wind Energy Fisheries Working Group (Working Group) to address offshore wind energy project impacts to certain fisheries and related interests, including the development of a statewide strategy to minimize impacts to ocean fisheries and providing for reasonable compensation to those affected, and requires the California Coastal Commission (Coastal Commission) to process a consolidated coastal development permit for new development associated with offshore wind energy projects and related transmission facilities, among other things. An act to add Sections 30001.3, 30601.4, 30616, and 30617 to, and to add Chapter 6 (commencing with Section 7100) to Part 2 of Division 6 of, the Public Resources Code, relating to public resources.

• SB 319, McGuire. Electricity: transmission planning and permitting. This bill requires specified actions related to electric transmission planning, including: requires a review and update to a December 2022 memorandum of understanding and related workplan among California energy agencies and California Independent System Operator (CAISO), the development of an electrical transmission infrastructure guidebook; and a report to the Legislature regarding the status of transmission projects. An act to add Section 25308 to, and to add and repeal Section 25308.5 of, the Public Resources Code, and to add Section 913.12 to the Public Utilities Code, relating to electricity.

• SB 355, Eggman. Multifamily Affordable Housing Solar Roofs Program. This bill makes changes to the Solar on Multifamily Affordable Housing (SOMAH) Program, including expanding the eligibility for the program in order to increase participation. An act to amend Section 2870 of the Public Utilities Code, relating to electricity.

• SB 410, Becker. Powering Up Californians Act. This bill requires the California Public Utilities Commission (CPUC) to establish by September 30, 2024, reasonable average and maximum target energization time periods in order to connect new customers and upgrade the service of existing customers to the electrical grid. This bill also requires reporting by electrical corporations and authorizes specified annual cost-recovery, subject to a cap. An act to add Article 14.5 (commencing with Section 930) to Chapter 4 of Part 1 of Division 1 of, and to repeal Sections 937 and 938 of, the Public Utilities Code, relating to electricity.

• SB 605, Padilla. Wave and tidal energy. This bill requires the California Energy Commission (CEC) to include as part of the 2024 integrated energy policy report, an evaluation of the feasibility, costs, and benefits of using wave energy and tidal energy. This bill also requires the CEC to submit a report on the findings to the Legislature by January 1, 2025. An act to add Chapter 18 (commencing with Section 25996) to Division 15 of, and to repeal Section 25996.1 of, the Public Resources Code, relating to energy.

• SB 746, Eggman. Energy conservation contracts: alternate energy equipment: green hydrogen: Tri-Valley-San Joaquin Valley Regional Rail Authority. This bill authorizes the Tri-Valley San Joaquin Valley Regional Rail Authority to enter into contracts related to green electrolytic hydrogen. An act to add Section 4217.19 to the Government Code, relating to public contracts.

• SB 825, Limón. Local government: public broadband services. Alters a definition of "local agency" in existing law to help metropolitan planning organizations (MPOs) and regional transportation planning authorities (RTPAs) qualify for broadband infrastructure grant funding from the California Public Utilities Commission (CPUC). An act to amend Section 53167 of the Government Code, relating to local government.

• SB 837, Archuleta. Energy: building energy standards: sealed and unvented attics. This bill requires the California Energy Commission (CEC), beginning with its review of Title 24 of the California Code of Regulations that is pending as of January 1, 2024, to consider revising the definition of "conditioned space, indirectly" for purposes of those regulations to include sealed and unvented attics, where the space is enclosed by the primary thermal and air barrier and directly adjoining conditioned space. An act to add Section 25402.13 to the Public Resources Code, relating to energy.
